This document outlines the Terms and Conditions of Use (“Terms”) for individuals who access our publicly available websites, those using our Services (defined below), and those who download any related mobile or software applications we provide (collectively, the “Sites” as detailed below). These Terms inform you of your legal rights and obligations when accessing or using the Sites. By accessing or using the Sites, you agree to be bound by these Terms, effective as of your first use of the Sites. 

Please read these Terms thoroughly, as they constitute a legally binding contract between you (“you” or “your”) and Property Health App (“Property Health App”). These Terms govern how you may use the Sites. By using the Sites or clicking the “I Accept” checkbox to access any Services, Software, or Mobile Application, you agree to abide by these Terms and any related agreements or policies found on the Sites (“Site Policies”). If you do not agree, you may not access or use the Sites. 

Key Definitions in These Terms: 

• Property Health App Platform: Refers to all Property Health App products and all associated apps and software, including KeyLink and all modifications, updates, and related documentation (“Documentation”). This also includes software code, interfaces, functionality, and any media content (e.g., text, images, audio-visual content). 

• Device: Any computer or mobile device capable of accessing the Sites. 

• Mobile Application: Software that allows you to access the Sites on a mobile Device. 

• Modifications: Any derivative works, updates, enhancements, or customizations made to the Sites. 

• Services: Refers to the Property Health App Platform and any other services accessed via the internet, cloud, or related Mobile Applications or Software. 

• Sites: Includes the main Property Health App website and any related URLs as well as all Services, Mobile Applications, and Software. 

• Site Policies: Any agreements or policies posted on or linked to from the Sites. 

Site Use and Access 

You are free to browse certain non-restricted areas of the Sites. For access to restricted sections, including specific Services, you need authorization, which requires an agreement between Property Health App and your affiliated legal entity. Authorized users will be given password-protected accounts. 

You are responsible for keeping your password secure and must notify Property Health App if it is compromised. Unauthorized sharing or misuse of login credentials is prohibited and may result in termination of access. 

Conditions of Access 

• Authorized Use Only: Your access is limited to the rights granted under these Terms. Unauthorized modifications or reproductions of the Sites or any parts of it are prohibited. 

• Compliance with Terms: You agree to follow these Terms and Site Policies strictly. 

Intellectual Property 

All rights to the Sites, including modifications and any intellectual property, remain with Property Health App and/or its licensors. Feedback provided to Property Health App may be used at its discretion without granting any rights to the user. 

Mobile Applications 

Property Health App may provide Mobile Applications compatible with your device. These applications may update automatically, and you agree that any use is subject to these Terms and applicable mobile device terms of service. 

Software Licensing 

Some Services include software for which a non-transferable, non-exclusive license may be granted if purchased by a legal entity you are associated with. This license is for internal business use and terminates upon cessation of authorization or contract. 

Data Protection and Privacy 

Property Health App may collect data as outlined in its Privacy Policy, available on the Site. This data may be stored globally and is subject to the Privacy Policy terms, including potential transfer to international territories if you access from outside the United Kingdom. 

Links to Third-Party Sites 

Links to third-party content within the Sites are provided as a convenience. Property Health App does not endorse or take responsibility for any third-party content, and your use of such links is at your own risk. 

Term and Termination 

These Terms begin upon your access to the Sites and continue until terminated. Property Health App reserves the right to modify, suspend, or terminate access at its discretion without notice. 

Disclaimer of Warranties, Indemnification, and Liability Limitations 

The Sites are provided “as-is,” with no warranties regarding their availability or functionality. You agree to indemnify Property Health App against claims arising from your use of the Sites. Property Health App’s liability for damages is limited to the maximum extent permitted by law, with no responsibility for indirect or incidental damages. 

By using the Sites and any related applications, you acknowledge and accept these Terms, including all terms related to usage, data, and liability as described above. If you disagree with any aspect, you are prohibited from accessing or using the Sites. 

The knowledge we have provided consists of a combination of legal aspects, regulatory compliance elements, experiences, and known findings. We cannot be held responsible if someone attempts to address a damp or mould issue and unintentionally worsens the situation for both the structure and themselves.
